Frequently Asked Questions

What is maternity discrimination?
Maternity discrimination includes: dismissal or redundancy because of pregnancy, refusal to allow maternity leave, failure to carry out risk assessments for pregnant employees, unfavourable treatment because of pregnancy-related illness, and denial of the right to return to the same job after maternity leave.
Are discrimination awards capped?
No. Unlike unfair dismissal (capped at £115,115 or 52 weeks' pay), discrimination compensation is uncapped. There is no statutory maximum for injury to feelings or lost earnings.
Do I need to go through ACAS first?
Yes. Before making an employment tribunal claim, you must notify ACAS for Early Conciliation. ACAS will try to resolve the dispute. If conciliation fails, you receive a certificate allowing you to proceed to tribunal.
What is the time limit for claims?
You must contact ACAS within 3 months less 1 day of the discriminatory act. The ACAS Early Conciliation process then extends your deadline. Late claims are only accepted in exceptional circumstances.
Can I claim while still employed?
Yes. You do not need to resign to bring a discrimination claim. However, continuing to work may affect the level of lost earnings you can claim.
Is the Vento award taxable?
No. Injury to feelings awards under the Vento bands are tax-free. However, lost earnings compensation is subject to income tax and National Insurance after the first £30,000.
