Frequently Asked Questions
What is wrongful dismissal?
Wrongful dismissal is being dismissed in breach of your employment contract, typically without the proper notice period. It is different from unfair dismissal, which relates to the reason for dismissal. You can claim wrongful dismissal with any length of service.
What is the difference from unfair dismissal?
Wrongful dismissal is a contractual claim (breach of contract) with no minimum service requirement. Unfair dismissal is a statutory claim requiring 2 years' service and considers whether the reason for dismissal was fair. You can claim both simultaneously.
Is there a cap on wrongful dismissal?
In the employment tribunal, wrongful dismissal claims are capped at £25,000. For larger claims, you must use the county court or High Court where there is no cap, but you may face costs risks.
What about garden leave?
If your employer places you on garden leave during your notice period, this counts as notice. You remain employed and are paid, even though you do not attend work.
Can I claim for lost benefits?
Yes. Wrongful dismissal compensation includes not just salary but also the value of benefits you would have received during the notice period, such as pension contributions, health insurance, car allowance, and bonuses.
Do I need to mitigate my loss?
Yes. You have a duty to take reasonable steps to find alternative employment during the notice period. Any earnings from new employment during the notice period shortfall will be deducted from your compensation.
