Can I claim for holiday sickness?
You can claim if you booked a package holiday, became ill due to the tour operator's or hotel's negligence (e.g. poor food hygiene), and the illness was not caused by something outside their control. The Package Travel and Linked Travel Arrangements Regulations 2018 make tour operators liable.
What evidence do I need?
Gather medical records from abroad and at home, photographs of conditions, receipts for medication, names of other affected guests, and a detailed timeline of symptoms. Report your illness to the hotel and tour operator rep while still on holiday.
How long do I have to claim?
You have 3 years from the date of illness to make a claim. For children, the 3-year window starts from their 18th birthday.
What if I got ill on a non-package holiday?
Claims under UK package travel regulations only apply to package holidays. If you booked flights and hotel separately, you would need to pursue a claim directly against the hotel, which is typically much harder.
Will I need to go to court?
Most holiday sickness claims settle out of court. Tour operators generally prefer to settle rather than face the costs of litigation. Around 95% of claims settle before reaching trial.
Can I claim for family members too?
Yes. Each affected person can claim individually. Parents can claim on behalf of children under 18.
