Who is liable for a slip or trip?
The occupier or landowner has a duty of care under the Occupiers' Liability Acts 1957 and 1984. For workplaces, the employer is liable under health and safety regulations. For public pavements, the local council is typically responsible.
What evidence should I collect?
Photograph the hazard immediately, report the accident (get a reference number), take names of witnesses, note weather conditions, keep all medical records and receipts, and photograph your injuries over time.
How long do I have to claim?
You have 3 years from the date of injury (or date of knowledge) to start court proceedings. For children, the 3-year limit starts from their 18th birthday. For workplace accidents, report to your employer immediately.
What if I was partly to blame?
Contributory negligence reduces your compensation by the percentage you were at fault. For example, if you were 25% to blame, your compensation is reduced by 25%. Even if partly at fault, you can still claim.
Are workplace slip claims different?
Employers have strict duties under the Health and Safety at Work Act 1974 and the Workplace (Health, Safety and Welfare) Regulations 1992. They must carry out risk assessments and maintain safe flooring, lighting and access routes.
What is the small claims track?
Personal injury claims for general damages under £1,000 are allocated to the small claims track, where legal costs are not recoverable. Above £1,000, claims go to the fast track where you can recover legal fees from the defendant.
