How much compensation can I claim?
Compensation depends on injury severity and impact. General damages (pain and suffering) are set by Judicial College Guidelines. Special damages (financial losses) are calculated individually. Use this calculator for an initial estimate.
What is the time limit for claiming?
The general time limit is 3 years from the date of injury or the date of knowledge (when you became aware the injury was caused by negligence). For children, the limit starts at age 18. There is no limit for those lacking mental capacity.
Do I need a solicitor?
While not legally required, a specialist personal injury solicitor significantly improves your chances of a fair settlement. Most work on a no-win-no-fee basis (Conditional Fee Agreement).
What are general damages?
General damages compensate for pain, suffering and loss of amenity (PSLA). The amount is determined by the Judicial College Guidelines based on the type and severity of injury.
What are special damages?
Special damages compensate for actual financial losses: lost earnings, medical expenses, travel costs, care costs, home adaptations, and any other out-of-pocket expenses caused by the injury.
Will claiming affect my employment?
It is automatically unfair dismissal to dismiss someone for making a legitimate personal injury claim. Your employer's liability insurer handles the claim, not your employer directly.
