CICA Eligibility Requirements

  • Crime reported to police — you must have reported the crime as soon as reasonably practicable
  • Cooperation — you must cooperate with police and the CICA throughout
  • Time limit — apply within 2 years of the incident (extensions possible in exceptional circumstances)
  • Unspent convictions — awards may be reduced or refused based on criminal record
  • Residency — the crime must have occurred in England, Scotland or Wales
  • Loss of earnings — only payable where incapacity exceeds 28 weeks, capped at £500/week
Important: CICA is a government-funded scheme of last resort. If you can claim compensation from the offender or through insurance, those routes should be pursued first.

Frequently Asked Questions

How do I apply to CICA?
Apply online at gov.uk/claim-compensation-criminal-injury. You can also apply by post. The process is free. You do not need a solicitor but one may help with complex claims. There is no court hearing for most applications.
What is the CICA time limit?
You must apply within 2 years of the incident. For childhood sexual abuse, the time limit runs from when you reported to police, not when the abuse occurred. CICA can extend the time limit in exceptional circumstances.
Can children apply to CICA?
Yes. Applications can be made on behalf of children by a parent or guardian. The 2-year time limit does not apply until the child turns 18. Awards for children are usually held in trust until they reach 18.
Does my criminal record affect my claim?
Yes. CICA will consider unspent convictions. Awards may be reduced or refused entirely based on your criminal record. The scheme uses a penalty points system based on the nature and recency of convictions.
Can I claim if I did not report to police?
Generally no. Reporting to police is a requirement. However, CICA may waive this in exceptional circumstances, particularly for historic childhood abuse cases. You should apply and explain why you did not report.
What about loss of earnings?
CICA only pays loss of earnings where incapacity exceeds 28 weeks. The calculation is based on statutory sick pay rates, capped at £500/week. The first 28 weeks are not compensated. Future loss of earnings may also be payable.
