Frequently Asked Questions
Is my employer liable for my injury?
If your employer failed in their duty of care under the Health and Safety at Work Act 1974, they are liable. This includes failing to provide training, PPE, safe equipment, or proper risk assessments. Your claim is against their employers' liability insurer.
What if I was partly at fault?
Contributory negligence reduces your award proportionally. For example, if you were 20% at fault for not wearing provided safety goggles, your compensation is reduced by 20%.
Can I be dismissed for claiming?
It is automatically unfair dismissal to dismiss an employee for making a legitimate personal injury claim. If dismissed, you would have an additional employment tribunal claim.
What about agency workers?
Agency workers are owed a duty of care by the host employer who controls the work environment. The Workplace (Health, Safety and Welfare) Regulations 1992 apply regardless of employment status.
Do I need to use the company doctor?
No. You can choose your own medical practitioner. Your solicitor will arrange an independent medical examination with a suitable expert.
What records should I keep?
Photograph injuries, keep medical receipts, record lost earnings, note witness details, get a copy of the accident book entry, and keep a diary of pain and limitations.
