How much are court fees in the UK?
Court fees for civil money claims range from 35 pounds for claims up to 300 pounds to 10,000 pounds for claims over 200,000 pounds. For claims between 10,001 and 200,000 pounds, the fee is 5% of the claim value. Family court fees include 593 pounds for divorce and 232 pounds for children applications.
Can I get help with court fees?
Yes, you can apply for fee remission (Help with Fees) using form EX160. Full remission is available if you receive qualifying benefits such as Universal Credit, Income Support, or JSA. Partial remission may apply if your income is below certain thresholds. You need your National Insurance number and 6 months of bank statements.
Do I get court fees back if I win?
If you win your case, the court can order the other party to pay your court fees as part of the costs order. However, this is at the courts discretion and depends on the track and circumstances. In small claims track cases, court fees are usually recoverable but other costs are not.
What is the small claims limit?
The small claims track applies to claims up to 10,000 pounds (or 1,000 for personal injury and housing disrepair claims). Small claims have simplified procedures, limited costs recovery, and no need for formal legal representation. The hearing fee is lower and you typically represent yourself.
How do I pay court fees?
Court fees can be paid online when issuing a claim through Money Claims Online, by debit/credit card at the court office, by cheque payable to HMCTS, or by solicitor account if represented. Fee remission applications must be made at the same time as filing. Some courts accept telephone payments.
Are employment tribunal fees still free?
Yes, employment tribunal fees were abolished by the Supreme Court in 2017 (UNISON v Lord Chancellor). There is currently no fee to bring an employment tribunal claim. However, you must go through ACAS early conciliation first, which is also free.
