Frequently Asked Questions
Are there fees to bring an employment tribunal claim?
No. Employment tribunal fees were abolished by the Supreme Court in July 2017 following the UNISON case. It is completely free to bring a claim. However, you must go through ACAS early conciliation first, which is also free. There is no fee at any stage of the tribunal process.
What is the basic award?
The basic award for unfair dismissal is calculated like statutory redundancy pay: 0.5 weeks pay per year of service under age 22, 1 weeks pay per year aged 22-40, and 1.5 weeks pay per year aged 41 and over. Weekly pay is capped at 700 pounds and maximum service is 20 years, giving a maximum basic award of 21,000 pounds.
What is the compensatory award?
The compensatory award compensates for financial loss caused by unfair dismissal. It covers loss of earnings, loss of statutory rights, loss of pension, and future loss. It is capped at the lower of 115,115 pounds or 52 weeks gross pay. The tribunal considers what efforts the claimant made to find new employment (duty to mitigate).
How long do I have to bring a claim?
Most employment tribunal claims must be brought within 3 months minus 1 day of the act complained of. For unfair dismissal, this is 3 months from the effective date of termination. ACAS early conciliation pauses this time limit. Late claims may be accepted if the tribunal considers it was not reasonably practicable to bring the claim in time.
What is ACAS early conciliation?
Before bringing an employment tribunal claim, you must contact ACAS for early conciliation. This is a free service where ACAS tries to help you and your employer reach a settlement without going to tribunal. The process takes up to 6 weeks. If conciliation fails, ACAS issues an early conciliation certificate allowing you to proceed to tribunal.
Is discrimination compensation capped?
No. Unlike unfair dismissal, compensation for discrimination claims under the Equality Act 2010 is uncapped. This includes injury to feelings awards (Vento bands), financial losses, and aggravated damages. Whistleblowing compensation is also uncapped.
