How long does a CCJ stay on your record?
A CCJ remains on the Register of Judgments for 6 years from the date of the judgment. During this time, it will appear on credit checks and significantly affect your ability to obtain credit, mortgages, and even some jobs. If you pay the CCJ in full within 30 days of the judgment, you can apply to have it removed entirely. After 30 days, paying it will show as 'satisfied' but it remains on the register.
Can I get a CCJ set aside?
You can apply to set aside (cancel) a CCJ if you did not receive the claim form, you have a valid defence, or the judgment was entered prematurely. The application fee is £275. You must act promptly — ideally within 30 days. You will need to show a real prospect of successfully defending the claim and explain why you did not respond to the original claim.
What happens if I ignore a CCJ?
Ignoring a CCJ does not make it go away. The creditor can enforce it through: a warrant of control (bailiff visits), attachment of earnings (deductions from wages), a charging order (secured against your property), a third party debt order (money taken from bank accounts), or in extreme cases, bankruptcy proceedings. The judgment remains enforceable for 6 years.
Can a CCJ affect my mortgage?
Yes, significantly. Most mortgage lenders will decline applications from borrowers with active CCJs. Some specialist lenders will consider applications if the CCJ is satisfied and you have a larger deposit (25%+). Even a satisfied CCJ on your credit file can increase the interest rate offered. Many employers and landlords also check for CCJs.
How do I pay off a CCJ?
You can pay in full immediately to minimise credit damage, or the court can set monthly instalments based on your income and expenditure. If paying in full within 30 days, apply for a certificate of cancellation (£15 fee) to have it removed from the register. After 30 days, apply for a certificate of satisfaction (£15 fee) to show it is paid.
