Frequently Asked Questions
What happens if I don't pay council tax?
If you miss council tax payments, the council sends a reminder within 14 days. If you still don't pay, they can demand the full year's amount immediately. The next step is a court summons for a liability order (costs £80–£110 added to your debt). With a liability order, the council can use bailiffs, deduct from wages or benefits, or in extreme cases, apply for your committal to prison (up to 90 days) or bankruptcy.
How much can bailiffs charge for council tax?
Bailiff fees are regulated by the Taking Control of Goods (Fees) Regulations 2014. The compliance stage costs £75 (letter before visit). The enforcement stage costs £235 plus 7.5% of the debt over £1,500. The sale stage costs £110 plus 7.5% of the debt over £1,500. These are maximum fees — bailiffs cannot charge more.
Can I go to prison for council tax debt?
Yes, but it is extremely rare and used as a last resort. The council must prove 'culpable neglect' or 'wilful refusal' to pay. The maximum sentence is 90 days. Before imprisonment, the council must have tried all other enforcement methods. If you simply cannot afford to pay, imprisonment is unlikely — it is reserved for those who can pay but refuse to.
Can I set up a payment plan for council tax arrears?
Yes, most councils will agree to a payment plan. Contact them as early as possible. A typical plan spreads arrears over 12 months on top of your current year's council tax. Some councils accept longer plans for hardship cases. If a liability order exists, the council's enforcement team handles arrangements. Citizens Advice can negotiate on your behalf.
Can council tax debt be written off?
Council tax debt can be included in a Debt Relief Order (debts under £30,000), an Individual Voluntary Arrangement (IVA), or bankruptcy. Councils can also write off debt in exceptional circumstances, though this is rare. The limitation period for council tax is 6 years from the date a liability order was obtained, after which the council cannot enforce it.
What council tax discounts am I entitled to?
You may qualify for: 25% single person discount, council tax reduction (low income), full exemption for students, severe mental impairment discount (100%), disabled band reduction, and care leavers' exemption. Many people overpay because they don't claim eligible discounts. Check with your local council or Citizens Advice.
