Key SDLT Rules & Deadlines
14-Day Payment Deadline: SDLT returns must be submitted and tax paid within 14 days of the completion date. Penalties and interest apply for late payment.
Who pays: The buyer is legally responsible for SDLT. In practice, your solicitor or licensed conveyancer calculates, submits the return, and pays HMRC on your behalf from completion funds.
Surcharge applies even to partial ownership: If either buyer already owns any residential property worldwide, the 5% additional dwelling surcharge applies to the entire purchase price unless an exemption or replacement of main residence rules apply.
Multiple Dwellings Relief: When purchasing 6 or more residential properties in a single transaction, you can apply mixed SDLT treatment or non-residential rates, whichever is lower.
Linked Transactions: HMRC may link multiple transactions between the same parties, which can push the combined value into higher bands. Always seek advice on portfolio acquisitions.
Refund on ADS: In Scotland, you can claim an ADS refund if you sell your previous main residence within 18 months of the new purchase.

What are the stamp duty rates in England for 2026?
From April 2025 (which continues into 2026), England reverted to its pre-September 2022 thresholds: 0% on the first £125,000; 2% on the portion from £125,001 to £250,000; 5% on £250,001 to £925,000; 10% on £925,001 to £1.5 million; and 12% on anything above £1.5 million. SDLT is calculated on a slice basis — each band only applies to the portion of the price that falls within it.
How much stamp duty do first-time buyers pay in 2026?
First-time buyers qualify for relief that reduces their SDLT liability. They pay 0% on the first £300,000 and 5% on the portion between £300,001 and £500,000. Crucially, if the purchase price exceeds £500,000, no first-time buyer relief applies and standard rates are charged on the full amount. Both buyers must be genuine first-time buyers to qualify.
What is the second home stamp duty surcharge?
From 31 October 2024, buyers of additional residential properties pay a 5% surcharge on top of the standard SDLT rates on every band. This applies to second homes, buy-to-let properties, and holiday lets. The surcharge applies to the entire purchase price from pound one. A refund can be claimed if the purchase was intended as a main residence replacement and the old home is sold within three years.

Scotland charges Land and Buildings Transaction Tax (LBTT) instead of SDLT. Rates for 2025/26 are: 0% up to £145,000; 2% on £145,001–£250,000; 5% on £250,001–£325,000; 10% on £325,001–£750,000; and 12% above £750,000. First-time buyers get an enhanced nil-rate threshold up to £175,000. Additional dwellings attract a 6% Additional Dwelling Supplement (ADS) on the full purchase price.
When must stamp duty be paid?
SDLT must be paid to HMRC within 14 days of the completion date. Late payment incurs automatic penalties starting at £100 for the first day and increasing over time, plus interest at the current HMRC rate. Your solicitor or licensed conveyancer will normally handle the SDLT return and payment using the funds provided at completion.
Does Wales have different stamp duty rules?
Yes. Wales operates Land Transaction Tax (LTT), which replaced SDLT in Wales in April 2018. LTT rates are: 0% up to £225,000; 6% on £225,001–£400,000; 7.5% on £400,001–£750,000; 10% on £750,001–£1.5 million; and 12% above. Additional dwellings attract a 4% higher rate applied across all bands. LTT is administered by the Welsh Revenue Authority, not HMRC.
Is stamp duty the same in Northern Ireland?
Yes. Northern Ireland uses the same SDLT framework as England because property tax has not been devolved to the Northern Ireland Assembly. All the same rates, thresholds, reliefs, and deadlines apply to property purchases in Northern Ireland as in England.
