What is the McCloud remedy?
The McCloud remedy (also called the 'McCloud/Sargeant' remedy) corrects age discrimination in public sector pension reform. When workers were moved from legacy (final salary) to reformed (CARE) schemes from 2015, older workers were protected but younger workers were not — the Supreme Court ruled this unlawful. The fix gives affected members the better of the two schemes for the 'remedy period' (1 April 2015 to 31 March 2022).

The McCloud remedy affects most unfunded public sector defined benefit schemes: NHS (1995/2008 sections), Teachers' Pension (Final Salary), Police (2006 Scheme), Firefighters (2006 Scheme), Civil Service (Classic/Premium/Nuvos to Alpha), Armed Forces, and Judicial pensions.
What is an RSS (Remediable Service Statement)?
A Remediable Service Statement is a personalised document from your pension scheme showing the value of your pension under both the legacy and CARE scheme for the remedy period. Your scheme administrator must provide this, and it forms the basis of your choice.
Do I get to choose which scheme applies?
Most members get a 'deferred choice' at retirement — meaning you choose at the point you claim your pension. If you retired between April 2015 and March 2022 and have already received pension, you may have an 'immediate choice' with a retrospective adjustment (including any tax changes).
What if I already paid too much Annual Allowance tax?
If your legacy benefits are higher and this exceeds your Annual Allowance, HMRC and your scheme have transitional protections. Annual Allowance calculations for the remedy period are recalculated. You may receive a refund of AA charges if the higher legacy benefits pushed you into charge unfairly.
When will I receive my Remediable Service Statement?
Most schemes are contacting members in stages from 2024 onwards. Check with your individual scheme administrator. NHS England and Scottish NHS schemes were among the first.
Can I change my mind after choosing?
No. Once you have made your choice (immediate or deferred), it is generally binding. You should take independent financial advice before making your decision, as it can affect death-in-service benefits, commutation, and survivor pensions.
Does the McCloud remedy affect the CARE accrual rate?
No — the remedy only covers the period April 2015 to March 2022. Your post-2022 pension accrues under the reformed CARE scheme for everyone, regardless of the remedy outcome.
