How are assets split in a UK divorce?
In England and Wales, the starting point is a 50/50 split of matrimonial assets, but courts consider factors under Section 25 of the Matrimonial Causes Act 1973: needs of each party, earning capacity, standard of living, age, contributions, and conduct. Non-matrimonial assets (inherited or pre-marriage) may be excluded. The court's overriding objective is fairness, not strict equality.
What is a pension sharing order?
A pension sharing order (PSO) transfers a percentage of one spouse's pension to the other as a pension credit. The recipient receives their own independent pension rights. PSOs are the cleanest way to divide pensions and are final — they cannot be revisited. The pension fund may charge £1,000–£3,000 to implement the order. An actuary's report (PODE) costing £500–£1,000 is usually needed to calculate fair sharing.
How is spousal maintenance calculated UK?
There is no fixed formula for spousal maintenance in England and Wales. Courts consider: the recipient's financial needs and earning potential, the payer's ability to pay, the standard of living during marriage, the length of marriage, and contributions. The general trend is towards a clean break where possible. Term maintenance (for a fixed period) is preferred over joint lives orders. Typical awards range from 25–33% of the difference in incomes.
Do I need a consent order?
A consent order is a legally binding court order that records your financial agreement. Without one, either party can make future financial claims against the other — even years after the divorce. The court fee is just £53, making it extremely cost-effective protection. A solicitor typically charges £500–£1,500 to draft one. It is strongly recommended for all divorcing couples, even those with limited assets.
What is the no-fault divorce process?
Since April 2022, England and Wales operate a no-fault divorce system. Either spouse (or both jointly) can apply, stating only that the marriage has irretrievably broken down. There is a mandatory 20-week reflection period from application to conditional order, then a further 6-week wait before the final order. The court fee is £593. The entire process typically takes 6–9 months minimum.
How long does financial settlement take?
Financial settlement can take 6–18 months depending on complexity and cooperation. Simple cases with agreed terms can be resolved in 3–4 months. Complex cases involving businesses, multiple properties, or offshore assets can take 18–24 months or longer. Mediation can significantly speed up the process. Court-imposed financial remedy proceedings have strict timetables but are still subject to court backlogs.
