Is there a legal night shift premium?
No — UK law (Working Time Regulations 1998) does not require a night shift premium. Employers must pay at least the National Living Wage but are not legally required to pay extra for night work.
What is the definition of a night worker?
A night worker is someone who regularly works at least 3 hours between 11pm and 6am as a normal part of their work. The WTR 1998 gives night workers specific protections.
What is the night worker hours limit?
Night workers must not work more than an average of 8 hours in each 24-hour period, averaged over a 17-week reference period. Workers doing hazardous or mentally demanding night work have an absolute 8-hour limit.
Am I entitled to a free health assessment?
Yes — employers must offer a free health assessment before you start night work, and then at regular intervals (typically annually). You cannot be forced to have it.
Can I be transferred from nights to days?
Yes — if your health is affected by night work, your employer must transfer you to day work if a suitable vacancy exists. You cannot be dismissed for health reasons related to night working.
What are typical night shift premiums?
There is no legal minimum but common UK premiums are: 10–15% for night allowance, 25–33% for anti-social hours, time-and-a-half (50%) in many manufacturing/logistics roles, and double time in some healthcare.
Does the National Living Wage apply at night?
Yes — the National Living Wage (£12.21/hour for 21+ from April 2025) applies to all hours, including night shifts. Any premium must be on top of NMW, not included within it.
What rest breaks apply on night shifts?
Workers on shifts of 6+ hours are entitled to a 20-minute rest break (WTR 1998). Night workers must also have 11 hours of consecutive daily rest between shifts.
Do night shifts affect pension contributions?
Pension auto-enrolment is based on qualifying earnings, not shift pattern. Night premiums count as earnings for pension contribution purposes if they are regular/contractual.
Can pregnant workers refuse night shifts?
Yes — a pregnant worker, new mother or breastfeeding worker has the right to be transferred to days or suspended on full pay if night work poses a health risk (assessed by risk assessment).
Do I pay more tax on night shift premium pay?
No — night shift premiums are paid and taxed as normal earnings through PAYE. There is no special tax treatment for anti-social hours pay.
What records must employers keep for night workers?
Employers must keep records showing they are complying with the 8-hour average limit. Records should be kept for at least 2 years.
